These terms and conditions outline the rules and regulations for affiliate marketing partners for the use of Stayclassy.in’s Website, located at https://stayclassy.in/.

By accessing this website and enrolling as an affiliate marketing partner, we assume you accept these terms and conditions. Do not continue to use Stayclassy.in if you do not agree to follow all of the terms and conditions stated on this page.

The following terminology is used extensively and applies to these Terms and Conditions.

“Affiliate marketing partner”, “Affiliate”, “You” and “your” refers to you, the person or a business entity logging on this website as an affiliate marketing partner is compliant to the Company’s terms and conditions. “Ourselves”, “We”, “Our”, “The Company” and “Us”, refers to our Company i.e., Stayclassy.in. “Party”, “Parties”, or “Us”, refers to both the affiliates and ourselves. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our Affiliate program in the most appropriate manner. All the processes that we undertake with the affiliate marketing partner will be in accordance with and subject to, prevailing law of India.

Any use of the above-mentioned terminology or other words in any form singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Terms and Conditions:

• The purpose of this program is to permit you to display products on your site and to earn affiliate fees for Qualifying Purchases made by your end-users. A “Product” is any item sold on the Stayclassy.in site.

• In order to help you advertise the products, we may provide to you data, images, text, link formats, widgets, links, and other linking tools, and other information in connection with the Program. This content will not include any data, images, text, or other information or content relating to products offered on any site other than the Stayclassy.in site.

• For the enrollment process, you must submit a complete and accurate program application. You must mention your site in your application. We will analyze your application and notify you of its acceptance or rejection. Your application may be rejected at our sole discretion if we find your site unsuitable. Unsuitable sites may include but not limited to those that:

• promote and/or contain sexually explicit materials;

• promote violence and/or contain violent materials;

• promote or contain defamatory materials;

• promote discrimination, and/or employ discriminatory practices, based on race, sex, religion, nationality, disability, sexual orientation, or age;

• promote and/or undertake illegal activities;

(g) Violate intellectual property rights.

If we reject your application, you can reapply at any time. But, if we accept your application and we later determine that your site is unsuitable, we may terminate this operating agreement at any time in our sole discretion.

• You will ensure that the information in your application and otherwise associated with your account, including email address and other contact information and identification of your site, is complete, accurate, and up-to-date. We may send notifications, approvals, and other communications to the email address then-currently associated with your account. You will be deemed to have received all the notifications, approvals, and other communications sent to that email address, even if the email address associated with your account is no longer functional.

• You will provide us with all the information that we request to verify your compliance with this agreement. If we determine that you have not complied with any requirement, we may (in addition to any other ways or remedies available to us):

• Withhold any commission payable to you.

• close any other accounts you may already have or may open in the future, without payment of any commission;

• terminate this Agreement,

• Undertake all of the above actions.

• You also give your consent to us for:

• sending you emails relating to the Program from time to time;

• monitoring, and disclosing information about your site and visitors to your site that we obtain in connection with your display of referral links and
• Monitoring, crawling, and investigating your site to verify all the compliances with this agreement.

• You are responsible for creating, posting, and ensuring the accuracy and appropriateness of, materials posted on your site (including all product descriptions and product-related materials and any information you include within or associate with referral Links)
• If in case, any excess payment has been made to you for any reason whatsoever, we reserve the right to adjust or offset the same against any subsequent amount payable to you.

• We shall not be held responsible for any content that may appear on your Website. You agree and are bound to protect and defend us against all claims that may arise on your website. No link or links should appear on your website that can be identified or interpreted as malicious, obscene

Or criminal, or which infringes, violates, or advocates the infringement or other violation of, any third party rights.

• We reserve the right to demand that you remove all links or any particular link to our website. You agree to immediately remove all links to our website upon demand. We also reserve the right to amend/change these terms and conditions at any time. For the period your website is linked to our website, you agree to be bound to and follow these linking terms and conditions.

• We do not ensure that the information on the affiliate marketing partner’s website or blog is correct, we do not warrant its completeness or accuracy; nor do we promise to ensure that the website is kept up to date.

• Stayclassy.in reserves the right to cancel any affiliate’s license without any prior notice if we find any fraudulent information on their website that may affect our brand name.
• Commission exclusions: We will not pay commission on any of the following:

• any product purchase that is not properly tracked or reported because the links from your site to the Stayclassy.in site are not properly functioning;

• any product purchased after termination of this Agreement;

• any order where a cancellation, return, or refund has been initiated; and

• Any claim by the affiliate without generating any real sales, fake claims or sending fake messages to us about sales will not be entertained.

• It is Mandatory to Register/Login before sharing any link from Stayclassy.in to Earn the Commission, We will not liable to pay any commission whose conversion came from without Affiliate login.

• Commission amount will be calculate on the basis of total order amount not as per product count. Example: If you are placing a single order which includes “IPhone 6 custom phone case” than commission amount will be INR 50. And If you are choosing multiple product in a single order than also commission amount will be INR 50.

• Affiliate is not allowed and will not issue any press release or make any other public communication with respect to this Agreement, your use of the Content, or your participation in the Program.
• This agreement gives the affiliate marketing partners a license for the limited purposes of advertising products on and directing end-users to, the Stayclassy Site in connection with the program, we hereby grant you a limited, revocable, non-sub licensable, non-exclusive non- transferable, royalty-free license to

• Copy and display the Content on your site; and

• Use of only those trademarks and logos that we may make available to you as part of content solely on your site.

• You will actively remove from your application and delete or otherwise destroy any Product Advertising Content that is no longer displayed on the Amazon Site or that we notify you is no longer available for your use.
• You will never include in your application, display network, or otherwise use product content with any spyware, worm, Trojan horse, malware, virus, or any other harmful code, or any software application not expressly and knowingly authorized by users prior to being downloaded or installed on their electronic devices.

• You will comply with all applicable laws of India including but not limited to ordinances, rules, permits, judgments, regulations, orders, licenses, decisions, and other requirements of any governmental authority that has jurisdiction over you.

• The term of this agreement will begin upon our acceptance of your application and will end when terminated by either you or us. Both the parties i.e., you or we may terminate this agreement at any time, with or without cause.
• If this agreement is terminated for any reason, with or without cause, any and all licenses you have with respect to content will automatically terminate and you will immediately stop using the content and promptly remove from your site and delete or otherwise destroy all links to the Stayclassy.in site.

• We may withhold your already acquired unpaid commission for a reasonable period of time following termination to ensure that the correct amount is paid (e.g., to adjust for any cancelations or returns).

• We may modify any of the terms and conditions with or without notice contained in this agreement or in our privacy policy document at any time and in our sole discretion.
• You and we both are independent entities/companies, and nothing in this agreement will create any partnership, agency, franchise, joint venture, sales representative, or employment relationship between you and us or our respective affiliates.

• This Operating Agreement will be governed by the laws of the Republic of India, without regard to the principle of conflict of laws. The courts at “Ahmedabad, Gujarat” shall have the exclusive jurisdiction over any dispute arising in any way from the matter under the program or this agreement.

• Notwithstanding anything to the contrary in this agreement, we may seek injunctive or other relief in any court of competent jurisdiction for any actual or alleged infringement of our or anybody else’s or entity’s intellectual property or proprietary rights.
